Good morning all,

Based on the adoption of 2008 Division III Proposal No. 5 at the convention, it is now permissible for an institution to provide academic and support services exclusively to student-athletes, provided the institution can demonstrate that similar services or programming are available to other groups of students on campus.

Prior to the adoption of the proposal, academic based programming or services could not be provided exclusively to student-athletes, as the programming and services had to be made available to students generally.

Based on discussions during the 2008 convention and based upon the membership’s decision to adopt proposal no. 5, the Division III Management Council noted significant confusion regarding the application of the previous Division III legislation regarding this topic. . As such, the Division III Management Council has determined to exercise its authority and relieve any institution that may have been in violation of the previous legislation from the obligation to file a self-report of those violations. Instead, institutions should simply detail any violations for their internal files on campus; however, they do not need to be sent to the NCAA national office.

In addition, the Division III Interpretations and Legislation Committee will be working on providing some educational resource regarding the application of legislation regarding services to student-athletes.
